Terms of Service

1. Scope

These Terms of Service govern the use of the EXAIOS platform operated by BMAI GmbH, Kronprinzstraße 3, 70173 Stuttgart, Germany.

2. Service Description

EXAIOS is a Decision Intelligence platform for energy infrastructure. It analyzes load profiles, simulates architectures, and delivers investment-ready recommendations. The platform operates deterministically — all computations are reproducible and auditable.

3. Contract Formation

The contract is formed upon registration and activation of the user account. There is no entitlement to activation.

4. Usage Rights

The user receives a simple, non-transferable right to use the platform within the scope of the booked service. Reports and analyses may be used for the user's own business purposes.

5. Data Protection and Confidentiality

Uploaded load profiles and analysis results are treated confidentially and not shared with third parties. Processing takes place on German servers (Hetzner Online GmbH). See Privacy Policy for details.

6. Liability

EXAIOS analyses serve as a decision basis, not a guarantee of economic outcomes. Liability for slight negligence is excluded unless essential contractual obligations are affected. Liability is limited to foreseeable, contract-typical damage.

7. Term and Termination

The contract runs indefinitely and may be terminated by either party with 30 days' notice to the end of the month. The right to extraordinary termination remains unaffected.

8. Changes to Terms

Changes will be communicated to the user by email. If the user does not object within 30 days, the new terms are deemed accepted.

9. Final Provisions

German law applies. Place of jurisdiction is Stuttgart, Germany. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
